In General
By accessing or using databases, web sites, images, graphics, audio files, video sequences, texts,
documentation and other materials (hereinafter referred to as "Objects") via AddContents'
websites or other AddContents services through AddContents GmbH (hereinafter referred to as "AC")
or its business partners (hereinafter referred to as "Services") the user agrees to be bound by the
following terms and conditions (the "Terms of Use").
To the extent that the user accesses the Services provided by the information provider or the supplier of information (hereinafter referred to as "Provider(s)") the respective Conditions of Use of the Provider(s) shall apply.
If the user does not agree with these Terms of Use and those of the Provider(s), the user is not permitted to access or to use the Services. top
1. Object of the Terms of Use
The object of the Terms of Use is to offer the user via the Services access to Objects.
The scope of the Services shall be defined as follows: The Services shall, as a rule, be constantly available, to the extent however, that such Services are temporarily unavailable due to maintenance work,
updates or rectification of technical problems, this shall not constitute a breach of AC's obligations hereunder.
In addition, AC and its business partners reserve their right to add or remove Objects as well as to modify or change the Services.
Neither AC nor its business partners shall assume responsibility for the completeness or accuracy of the information provided.
The Services do not constitute a recommendation on the part of AC or its business partners. AC and its business partners are not obliged to check the Objects.
By registering online, the user shall become a customer of AC and shall obtain the right to use the Services. Responsibility for the safe keeping and protection of user data from misuse shall be borne by the user. top
Liability
(1) AC shall be liable for damages arising from bodily or personal injury or health directly attributable to a negligent breach of obligation by AC or a wilful or
negligent breach of obligation by a legal representative or person employed by AC.
In addition, AC shall be liable for all other damages which are directly attributable to a wilful or grossly negligent breach of obligation by a legal representative or person employed by AC.
In addition, AC shall be liable, without limitation, for damages, which fall within the ambit of mandatory legal provisions, such as the Product Liability law, legal warranties or fraudulent intent.
(2) Notwithstanding its liability for wilful and gross negligence, AC shall be liable for breach of those contractual duties, the observance of which are of particular significance in order to achieve the purpose of the contract ("cardinal obliga-tion"). In this case, liability shall be limited, however, to foreseeable damages which are typical for the type of contract. Further, liability for indirect or consequential damages shall be excluded to the extent that such damages are not foreseeable.
(3) AC shall not be liable to business enterprises for a minor negligent breach of other contractual obligations which do not constitute a cardinal obligation. AC's liability to consumers in such cases shall be limited to foreseeable damages which are typical for the type of contract. AC shall not be liable for non-foreseeable indirect or consequential damages.
(4) The user is obliged to make a claim for damages in writing, at the latest, within 14 days after becoming aware of the defect.
(5) The user is obliged, at the time of registration, not to provide any false data and to maintain the secrecy of his access data (user name, password), in particular the user shall not pass his access data to a third party and shall protect his access data from misuse or loss. AC and its business partners shall not be liable, regardless of the aforementioned liability provisions, for damages which the user incurs as a result of breach of this obligation.
These Terms of Use shall apply to all accesses (combination of user name and password) created and used hereunder. Unless expressly approved in writing by AC in advance, an access is valid for use only in the country in which the user, according to the information provided by him, resides.
If the user allows a third party to use the password or if such occurs, with the prior written consent of AC and/ or if, upon request, the Provider supplies Objects to a third party, the user shall be liable for use by such third party as if it were for his own use. In the event of loss of a password, the user is obliged to notify AC immediately in writing.
To prevent misuse, AC and its business partners reserve the right to block or to delete access if input is false. top
Rights of Use
AC is the owner of the rights in the research results subject to the rights of third parties, in particular, the Providers.
The research results may only be used for the user's own use or, in the case of an information broker, for its client's own use.
Any Objects obtained shall be used once only. The copying of Objects which have been obtained via the Services (including their reproduction and permanent storage on the user's system) as well as the distribution, making publicly available and other public reproduction) of the Objects is not permitted.
The user shall not sell, exchange transfer, rent, lease, loan, resell or in any other manner exploit any Object received from the Services or obscure or remove the copyright notices contained on any Object received from the Services.
In the case of Object callup by an information broker who is acting on behalf of a third party the Object can only be passed on to the client once and must be deleted by the information broker and the third party without delay. top
Prices and Terms of Payment
The Services which are used by the user shall be charged on the basis of the valid list prices in force.
The stated prices are inclusive of value added tax. The user will be invoiced for any additional taxes and duties.
Invoices which are addressed to clients living abroad shall contain, in addition to the prices stated in the price list, a lump sum for bank charges. All payments shall be charged in Euro without deduction and shall be due immediately upon receipt of the invoice.
In the event of a delay in payment, AC or its business partners are entitled to block online access. top

Rights and obligations
Agreement between AddContents GmbH, Bismarckstr. 17, 91054 Erlangen (hereinafter referred to as "AC")
and the person(s) who downloads and/ or uses the AddContents WebService ("WS")
(hereinafter referred to as "Partner") - AC and Partner hereinafter referred to as "Party(ies)" -
Preamble
This Agreement governs the legal relationship between AC and its Partner.
AC offers its Partners the WS in order to provide simplified access to sources and content of content providers
(hereinafter referred to as "Provider"). Partners provide users with a particular offer. top
Rights and obligations
The Partner shall have the right to download integrate and offer the WS to its users.
By downloading and using the WS, the Partner agrees to the following:
- The Partner is obliged, using a suitable method, to ensure that AC's Terms of Use are incorporated when using the Services (e.g. by stating a link and providing a corresponding explanation).
- The content of a snippet field (title, source etc) as well as the content of a document must be shown by the Partner to its user unchanged (i.e. exactly as de-livered by AC).
- The minimum price that the Partner must show its users is AC or the WS's delivery price.
- The Partner application must contain the words "powered by Truffels.com" within the direct proximity of the search field. top
